Nope. The hat he wears actually perfectly fits into a 16x8 shape without overlapping with the rest of him. Basically, those two tiles use the face palette, whereas the ones below it use the armor palette.
Shouldn't the color that fills his hat be removed in the disassembled sprites, since it uses the same layer and colors as his face?
