Most of the boss could be put on the background layer, and the only part of it that overlaps with the background, its fin, could be recreated with sprites, maybe you could even change the background color per scanline to replace some background tiles, resulting in even less overlap. There would still be a lot of flicker, of course.
Considering an actual NES just plain WOULD NOT handle that many sprite tiles at once...
I feel like this is one of the largest bosses in classic Mega Man, or at the very least one of the widest.
