thejohnston7's right. White counts as a transparency for these, because the palette is already taken up by black and two shades of grey (meaning four colours total including transparency, if white wasn't transparent then that'd be five).

Are you sure? The level backgrounds are not just pure white.
The intro sprites don't have the white included in them. The white is just the background showing through.
